How we can help you buy a property in Spain
COSTA LUZ ABOGADOS can manage your purchase transaction to ensure that your interests are protected and importantly, that you receive essential independent advice in relation to your intended purchase.
Before signing any type of Reservation or Purchase Contract it is always advisable to first seek advice from a lawyer in order to be sure that you are fully aware of all of your rights and obligations under any given contract or mortgage obligation and essentially, that you can be confident that your intended property has all of the necessary planning permissions, licences, that it can be delivered free of charges and encumbrances and that it is properly registered.
Our team will provide the following services in the purchase transaction.
Assistance
Help you to obtain the relevant documentation that will be necessary upon completion, in particular:
" We will make arrangements for a Power of Attorney to be granted enabling another stipulated person to attend Completion on your behalf if you are unable to attend in person.
" We will arrange the Notary appointment at a Notary close to wherever you are based and ensure that the Power is properly legalised at the Foreign Office in order to be valid in Spain.
" We can arrange the application for the obligatory NIE number if you are not in possession of one. This is an identification number which Spanish Law requests from any non-Spanish resident and, importantly, it is a Notary requirement in order to be able to Complete.
" Trusteeship: We act as a trustee (fiduciary) on behalf of the BHW Postbank AG and pass on all applications for loans to the BHW headquarter in Hameln, Germany. Furthermore we take care of the transcription of your loan in Spain in form of mortgages.
" Valuation: We take care of the valuation of the real estate you are interested in whenever you ask us to or when financing.
Registry Reports
Obtain a registry report "nota simple" or "certificación" from the land registry or commercial registry in order to see if there are any outstanding charges or debts on the property. This will also ensure that the Seller is the registered Owner of the property with the right to sell.
Verification
Verify the urban classification and the urban development plans of the land, property or rental, on which the realty is built.
Verify that all the building licences are in place or if there are any restrictions in order to ensure that there are no surprises when you enter into negotiations to buy a property.
Drafting
Draft all the contracts that will be necessary upon Completion: Preliminary Contracts, Draft Deed of Sale and Deeds of Sale ("Escritura").
Negotiate
Negotiate any issues arising with the Seller to ensure that your position as a Buyer is protected.
Independent Advice
Provide you with full independent advice with regard to all aspects of your purchase to enable you to make an informed decision about the purchase.
Arrangements
Arrange for Completion before the Notary and representation by your Attorneys during which time the Purchase Deeds will be signed, registered at the Land Registry and the due fees paid on your behalf.
Payment Options
Provide you with a breakdown of expenses which will set out all payments due in order to Complete.
